We use Wix Analytics. On our websites, analytics data that requires cookie consent is collected only after the relevant consent has been given. We currently do not have Google Analytics, Google Tag Manager, Meta Pixel/CAPI, TikTok Pixel, Hotjar, Microsoft Clarity or Yandex.Metrica connected to our websites.

Where can personal data be processed?
Primarily in Switzerland and through the international infrastructure used by Wix, Wix Payments and their service providers. The relevant countries and safeguards are explained in Section 11.

2. Applicable Data Protection Law

BISTRY is established in Switzerland and processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and the Swiss Data Protection Ordinance.

Where their territorial requirements are met, additional laws apply to the relevant processing, including Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR), the UK GDPR, the UK Data Protection Act 2018 and other mandatory privacy and electronic-communications laws.

Nothing in this Privacy Policy limits mandatory rights available under applicable data protection law.

3. Personal Data We Process

3.1 Contact and Identification Data

We process the contact and identification information relevant to your interaction with AH Magazine, including:

Authentication and password management are handled through the Wix platform. BISTRY does not store your password in readable form.

BISTRY does not store full payment-card credentials on its own systems. Payment-card information is entered into and processed through the payment infrastructure described in Section 8.

  • dispatch and delivery status;

  • correspondence relating to the delivery.

When you contact us or submit a form, we process:

  • information necessary to respond to or manage your request.

 

This includes enquiries concerning editorial matters, memberships, purchases, partnerships, press, advertising, customer support and other AH Magazine activities.

3.6 Editorial Submissions and Contributions

If you submit artwork, photographs, texts, biographies, press materials or other editorial content, we process the information contained in the submission in order to assess, manage, edit and, where agreed, publish the material.

Where material is submitted for publication or public presentation, the published material and agreed attribution information become publicly accessible. They can subsequently be indexed, cached, quoted or otherwise processed by search engines and other independent public information services.

We do not request special-category personal data as part of ordinary membership and purchasing processes.

Where editorial material contains sensitive or special-category personal data, we process such information only where it is relevant to the editorial purpose and a valid legal basis or applicable journalistic or other statutory provision permits the processing.

 

3.7 Newsletter and Marketing Data

If you subscribe to newsletters or marketing communications, we process:

Purpose: Creating and administering accounts and memberships and providing access to members-only content and digital editions.

Legal basis: Performance of a contract, Article 6(1)(b) GDPR.

Retention: During the contractual relationship and afterwards only for as long as required for contractual claims, legal obligations, security or dispute resolution.

Purchases, Payments, Invoices, Refunds and Chargebacks

Purpose: Processing purchases, payments, invoices, refunds and chargebacks.

Data concerned: Contact, order and transaction data.

Legal basis: Performance of a contract under Article 6(1)(b) GDPR and compliance with legal obligations under Article 6(1)(c) GDPR.

Retention: Accounting and transaction records are retained for the statutory period applicable to them, generally 10 years where Swiss accounting law requires this.

Order Fulfilment and Delivery

Purpose: Fulfilling and delivering orders.

Data concerned: Contact and delivery data.

Legal basis: Performance of a contract, Article 6(1)(b) GDPR.

Retention: Until fulfilment and afterwards for as long as required to deal with delivery claims, legal obligations and applicable limitation periods.

 

Membership Administration, Cancellations and Withdrawals

Purpose: Managing memberships, renewals, cancellations, withdrawals and refunds.

Retention: For as long as required to administer the contract and demonstrate compliance with applicable contractual and consumer-law obligations.

Enquiries and Customer Support

Purpose: Responding to enquiries and providing customer support.

Legal basis: Performance of a contract under Article 6(1)(b) GDPR where applicable; otherwise our legitimate interests under Article 6(1)(f) GDPR.

Retention: Until the matter is resolved and afterwards only for the period required for legitimate records, claims or legal obligations.

 

Editorial Submissions

Purpose: Assessing, editing, publishing and archiving editorial submissions.

Data concerned: Contact information and submitted material.

Retention: Until consent is withdrawn, an objection is made or the communication is otherwise discontinued. Limited compliance records can be retained afterwards.

Unsubscribe and Suppression Records

Purpose: Maintaining a record so that an unsubscribe request or marketing objection continues to be respected.

Before relying on legitimate interests, we consider whether those interests are overridden by the rights and freedoms of the individuals concerned.

 

5.2 Where We Rely on Consent

We rely on consent where applicable law requires it, including for certain marketing communications and optional cookies or analytics technologies.

You can withdraw consent at any time with effect for the future. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

5.3 When Providing Personal Data Is Required

For a membership or purchase, the information necessary to create the relevant account, process payment and fulfil the contract is a contractual requirement.

If you do not provide the information necessary for the relevant contract, we cannot create the membership, process the order, take payment or make the delivery.

Certain transaction and accounting information must be retained because applicable tax, accounting or commercial laws require it.

Providing information for a newsletter subscription, general enquiry or voluntary editorial submission is optional. If you do not provide the relevant information, we cannot provide the corresponding newsletter, respond to the enquiry or assess the submission.

6.2 Optional Cookies and Consent

Our cookie-consent interface allows visitors to:

  • manage cookie categories;

  • change their preferences later through the Cookie Settings function.

 

Where applicable law requires consent, non-essential cookies and scripts are not loaded until the relevant consent has been given.

Blocking essential technologies can prevent certain functions, including account login or checkout, from operating correctly.

 

6.3 Wix Analytics

Wix Analytics forms part of the Wix platform and provides website traffic and usage information.

Because our cookie-consent banner is enabled, Wix Analytics traffic data that relies on consent-controlled website events is collected only after the visitor has accepted the relevant cookies.

Wix can also generate certain aggregated, server-side operational or blog statistics that do not provide us with information identifying an individual visitor.

Visitors can decline analytics cookies or change their choice through the Cookie Settings function.

 

6.4 Third-Party Advertising and Tracking Tools

We currently do not have the following integrations connected to our websites:

  • Google Analytics;

  • Google Tag Manager;

  • Meta Pixel or CAPI;

  • TikTok Pixel;

  • Hotjar;

  • Microsoft Clarity;

  • Yandex.Metrica.

 

We also do not currently use custom tracking code for these services.

If our tracking technologies change, we will update the relevant privacy and cookie information and obtain consent before activating technologies for which prior consent is legally required.

7. Wix Platform

Our websites and related digital business functions operate on Wix.

Wix provides or supports:

  • website hosting and content delivery;

  • Members Area and user accounts;

  • forms;

  • the online store and checkout;

  • pricing plans and memberships;

  • order administration;

  • multilingual functionality;

  • blog functions;

  • galleries;

  • website security;

  • cookie-consent management;

  • related site-administration functions.

 

For personal data that BISTRY determines to collect and use through the Wix websites, BISTRY acts as controller and Wix generally acts as processor under its contractual data-processing arrangements.

Wix also processes certain information for its own platform-security, abuse-prevention and legal-compliance purposes under its own responsibility.

 

8. Payments

Payments made directly through the AH Magazine website are currently processed through Wix Payments.

Wix Payments uses payment processors, acquiring banks and card networks. Depending on the relevant transaction, Wix Payments can use processors including Adyen and Stripe and their relevant affiliates.

These payment organisations process information required to:

  • authorise and settle payments;

  • authenticate transactions;

  • prevent and investigate fraud;

  • process refunds and chargebacks;

  • comply with payment-network, financial and regulatory obligations.

 

BISTRY receives the transaction and payment-status information required to administer the relevant purchase, membership, refund, accounting record and customer relationship.

BISTRY does not store full payment-card credentials on its own systems.

Where a separate PayPal payment option is made available and you choose to use it, PayPal processes the relevant transaction under its own privacy information and legal responsibility.

9. Recipients of Personal Data

We disclose personal data only where it is necessary for the relevant purpose.

Categories of recipients include:

  • Wix and its authorised subprocessors;

  • payment processors, acquiring banks and card networks;

  • postal, courier, fulfilment and distribution providers where physical delivery is required;

  • printing and production providers where required for a specific publication or service;

  • accountants, tax advisers, legal advisers and other professional service providers;

  • competent courts, regulators, tax authorities and other public bodies where disclosure is legally required.

 

Processors receive only the information required to perform their service and are subject to applicable contractual and data-protection obligations.

Certain recipients, including payment institutions, postal operators, professional advisers and public authorities, can act as independent controllers under the law applicable to them.

BISTRY does not sell personal data and does not disclose personal data to data brokers.

10. Social Media and External Services

AH Magazine maintains profiles on social-media platforms and links to third-party websites and services.

If you contact us through a social-media platform, the relevant platform processes information according to its own privacy terms, while BISTRY processes the information required to respond to your communication.

Where you follow a link from an AH Magazine website to an external service, the external provider processes the subsequent activity under its own responsibility.

Where third-party content is embedded in our websites and its activation requires non-essential technologies, the relevant consent controls apply where the technology can be controlled through our website platform.

11. International Transfers

BISTRY is established in Switzerland.

Personal data processed through our Wix websites is initially processed by Wix.com Ltd. in Israel and can subsequently be processed by Wix group entities and subprocessors in:

  • United States

  • Brazil

  • Mexico

  • Luxembourg

  • Lithuania

  • India

  • Germany

  • Ireland

  • United Kingdom

  • Ukraine

  • Netherlands

 

Personal data is also processed in Switzerland in connection with BISTRY's own operations.

Payment processing can additionally involve entities and infrastructure in Switzerland, the European Economic Area, the United Kingdom and the United States, depending on the processor, payment method and transaction.

Where the relevant destination benefits from an adequacy decision or equivalent recognition under the law governing the transfer, personal data can be transferred on that basis.

For transfers to destinations for which an adequate level of protection is not recognised, the relevant controller or processor uses legally recognised safeguards where required, including contractual transfer mechanisms such as Standard Contractual Clauses and supplementary technical, contractual or organisational measures.

Wix states that transfers between Wix entities and to its relevant subprocessors are covered by appropriate contractual and security safeguards.

You can contact BISTRY for further information about the safeguards applying to a particular category of transfer.

The Wix subprocessor infrastructure can change over time. We review the relevant information periodically and update this Privacy Policy where a material change affects our processing.

12. Retention of Personal Data

We retain personal data only for as long as necessary for the purpose for which it was collected, for another compatible lawful purpose or for a mandatory legal retention period.

In particular:

  • accounting books, supporting accounting documents and records subject to Swiss statutory accounting requirements are generally retained for 10 years;

  • contract, transaction and payment information is retained for the applicable legal retention and limitation periods;

  • account and membership information is retained for the duration of the relationship and afterwards only where required for legal obligations, security, evidence or claims;

  • delivery and support information is retained for the period necessary to complete the matter and deal with potential claims;

  • editorial submissions and publication records can be retained for the duration required by the relevant publication, licence and legitimate editorial archive;

  • marketing information is used until consent is withdrawn, an objection is made or the relevant communication is discontinued;

  • limited suppression information can be retained after an unsubscribe request to ensure that the objection continues to be respected;

  • technical and security information is retained only for the period necessary for its technical, operational or security purpose.

 

Where an exact period cannot reasonably be fixed in advance, we determine retention by reference to the processing purpose, contractual requirements, statutory retention obligations, applicable limitation periods and the need to establish, exercise or defend legal claims.

When personal data is no longer required, it is deleted or irreversibly anonymised, subject to lawful retention obligations and ordinary backup cycles.

13. Marketing Communications

We send direct marketing communications where you have given valid consent or where another legal permission specifically applies to the relevant communication.

Our general newsletter and promotional-email practice is currently consent-based.

You can unsubscribe from marketing at any time through the unsubscribe function in the message or by contacting us.

An objection to marketing does not prevent BISTRY from sending non-promotional communications required for an existing account, purchase, membership, payment, security matter, legal notice or customer-service request.

We retain limited suppression information where necessary to ensure that an unsubscribe request or marketing objection continues to be respected.

14. Automated Decision-Making and Profiling

BISTRY does not use solely automated decision-making in its ordinary editorial, membership or marketing activities where the decision produces legal effects concerning an individual or similarly significantly affects that individual.

BISTRY does not use website behaviour to create advertising profiles.

Payment processors, financial institutions, card networks and security providers use their own fraud-prevention, payment-authorisation, risk-management and security systems under their own legal responsibility.

Where applicable law gives you rights in relation to an automated decision, those rights remain unaffected.

15. Children

AH Magazine's commercial memberships and purchasing services are not directed at children.

We do not intentionally request children's personal data as part of ordinary membership or purchasing activities.

Where a specific activity involves a child or where processing relies on a child's consent, BISTRY observes the age, parental-authorisation and other safeguards required by the law applicable to that activity.

If you believe that personal data relating to a child has been provided to us in circumstances where it should not have been collected, please contact us.

16. Your Data Protection Rights

The precise rights available to you depend on the law applicable to the relevant processing.

Subject to the applicable legal requirements and exceptions, your rights can include the right to:

You do not have to complete BISTRY's internal complaint procedure before exercising a statutory right to contact a supervisory authority.

BISTRY uses technical and organisational security measures appropriate to the nature of the personal data and the risks involved.

These include:

  • HTTPS/TLS encryption;

  • authentication and access controls;

  • Wix platform security controls;

  • measures against unauthorised access, misuse, attacks and fraud;

  • operational and backup safeguards appropriate to the systems used.

 

No electronic transmission or storage system can provide absolute security.

Where a personal data breach occurs, BISTRY assesses the incident promptly and makes notifications to competent authorities and affected individuals where the legal thresholds applicable to the incident require this.

We update this Privacy Policy when material changes occur in our services, service providers, processing activities, technology or legal obligations.

The current version and the date of its latest update are published on our primary website.
